Sports science is concerned with reforming sports.  memo to the government

The National Coordination of Exercise Science (CoNaSM), on August 1, shared a note on the legislative decree of February 28, 2021, N. 36, in implementation of Article 5 of the Law of 8 August 2019, n. 86, reorganization and reform of provisions for professional sports bodies as well as sports work.

The memorandum to highlight some of the confusion and suggest reflections on the issue, which is causing deep concern throughout the motor science movement, also in reference to the press conference announcing the imminent publication of the corrective decree issued by Legislative Decree February 28, 2021, n. 36as well as for graduate-related articles in Automotive Science.

In detail, the concern relates to some steps:

Article 41 – Paragraph 6 deals with the possible equations for the title World of Motion. The law states that “the criteria for recognition of equivalent qualifications for the purpose of practicing the profession are, respectively, from the basic kinesiology referred to in paragraph 2, the kinesiologist for preventive and conditioned kinetic activities referred to in paragraph 3, from the sports kinesiologist referred to in paragraph 4, and the athletic director referred to in paragraph 5″.

It must be remembered that equivalencies are recognized, usually, for a similar level of training and that according to the European Framework of Reference (EQF), a three-year degree is level 6 and a master’s degree is level 7, while higher degrees reach technical specialization (those issued by FSN) to Level 4 and therefore it would be difficult to maintain potential equivalence for the above courses based on the equivalency of qualifications of different weight and value.

Article 42 – In paragraph 1, the text reads as follows: “Sports and sports courses and activities offered in gymnasiums, centers and sports facilities of all kinds, against payment of fees for any reason, including in the form of membership fees, shall take place in coordination with the kinesiologist or a particular discipline teacher, whose names shall be adequately made public.”

As stated in paragraph 1 of Article 42, it appears to be inconsistent with the will of the legislator because it is in stark contrast to the above in the commentary to paragraph 6 of Article. 41, given that the coordination of courses and kinetic and sports activities presented in gymnasiums, centers and sports facilities of all kinds is attributed to both the kinesiologist and the coach in a particular discipline, i.e. to a subject, the latter, not in possession of the necessary requirements to be equivalent with kinesiology. Moreover, the need to preserve the provision of art. 42, paragraph 4, whereby they are exempted from complying with Article 42, paragraph 1, (i.e. the coordinator’s obligation to be present) exclusively for competitive sporting activities, in order to avoid that the sole distinction between the coordinator’s obligation to be present or not, is the sole affiliation with the FSN, regardless for the performance of competitive activities. That is, we want to avoid distinguishing between companies that do not carry out competitive activities and that do not belong to the FSN (which will have an obligation to attend the coordinator) and companies that, although not carrying out competitive activities, like the former, are instead affiliated with the FSN (and are therefore exempt from Commitment to having a coordinator), with the inevitable diversification of management costs.

Finally, with reference to the persistence of breezy art. 42, paragraph 1, where from the drafts circulating on the net an attempt has been made to include an incident relating to the exclusion of the kinesiology profession from the health professions, it seems appropriate to point out that the eventual recognition, as a health profession, in the master’s degree in our opinion, deserves preventive and adaptive motor activity Comparison at the legislative level between all interested parties.
